These Terms of Use ("Terms") govern your access to and use of Elofey (elofey.com, the "Service"), operated by Limited Liability Company "ARPHAREY" (LLC "Arpharey"; Kyrgyz: ОсОО «АРФАРЕЙ»), registered address: 8 Pionerskaya St., Romanovka, Sokuluk District, Chuy Region, 724807, Kyrgyz Republic; taxpayer number (TIN) 01706202210346. 1. The Service

Elofey provides social media management and automation tools, including scheduling and publishing, Instagram comment automation, private replies and messaging features for connected professional accounts, delivered through official platform APIs.

2. Accounts

• You must provide accurate registration information and keep your credentials confidential.
• You must be at least 16 years old and have the authority to bind the organisation on whose behalf you use the Service.
• You are responsible for all activity under your account.

3. Acceptable use

• Use the Service only in compliance with applicable law and with the terms, policies and technical limits of the connected platforms (including Meta Platform Terms and Instagram Community Guidelines).
• Automation features (automatic replies, private replies, messages) may be used only within the rules and windows defined by the applicable platform. You are responsible for the rules, templates and content you configure.
• No spam, no unsolicited bulk messaging, no misleading content, no scraping of third-party data, no infringement of third-party rights, no attempts to bypass platform or Service limits.
• We may suspend accounts that violate these Terms or create risk for other users or platforms.

4. Platform dependencies

The Service depends on third-party platforms (Meta, Instagram and others). We do not control and are not responsible for their availability, API changes, moderation decisions, or delivery of messages and replies within their products. Successful acceptance of an action by a platform API does not guarantee its display or delivery inside that platform.

5. Subscriptions and payments

• Paid plans are billed in advance per the selected period. Prices and plan features are shown on the Service and may change with notice.
• Unless required by law, fees are non-refundable except where explicitly stated.
• Failure to pay may result in suspension or downgrade of the account.

6. Your content

You retain all rights to the content you create and process through the Service. You grant us the limited licence needed to host, process and transmit that content solely to provide the Service. You represent that you have the rights and permissions required for the content and for the audiences you automate interactions with.

7. Intellectual property

The Service, its software, design and documentation are owned by LLC "ARPHAREY" or its licensors. No rights are granted except the right to use the Service under these Terms.

8. Disclaimers and liability

• The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.
• We are not liable for indirect, incidental or consequential damages, loss of profits, data or goodwill. Our aggregate liability is limited to the amounts you paid for the Service in the 12 months preceding the claim.
• Nothing in these Terms excludes liability that cannot be excluded by law.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms. Upon termination, your data is handled as described in our Privacy Policy and Data Deletion Instructions.

10. Governing law

These Terms are governed by the laws of the Kyrgyz Republic, unless mandatory consumer protection rules of your country of residence provide otherwise.

11. Changes

We may update these Terms. Continued use of the Service after changes take effect constitutes acceptance.
